Overview

This website and all associated subdomains (including getboxunboxed.com, shopboxunboxed.com, boxunboxed.design, and boxunboxed.store) are operated by FRM Online Endeavors LLC DBA BoxUnboxed. Throughout the site, the terms “we”, “us” and “our” refer to the company. By visiting our site and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions.

Section 1 - Online Store Terms

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction.

Section 2 - Accuracy of Custom Orders & Dimensions

Because we specialize in pre-fabricated DIY architectural kits (including acoustic panels, cabinetry layouts, and pergolas) and fine custom jewelry, you acknowledge that you are entirely responsible for providing accurate measurements, sizing specifications, and spatial boundaries. We design and source strictly based on user-provided data. We are not liable for installation failures, site-readiness issues, or inaccurate sizing inputs provided by the customer.

Section 3 - Modifications to the Service and Prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service (or any part or content thereof) without notice at any time.

Section 4 - Products or Services

Certain products or services may have limited quantities and are subject to return or exchange only according to our Refund Policy. We have made every effort to display as accurately as possible the colors and images of our materials (metals including sterling silver and varying gold karats, custom gemstones, and architectural finishes) that appear at the storefront. We cannot guarantee that your computer monitor's display of any color will be completely accurate.

Section 5 - Multi-Branch Ordering & Split Shipping

Because we operate multiple distinct product branches (including custom fine jewelry, modern architectural materials, and interactive pet products) under the company umbrella, orders containing items from different collections may be fulfilled from separate hubs. You acknowledge that your order may be divided into split shipments, arriving in separate packages via different shipping carriers (e.g., standard parcel carriers versus specialized heavy freight carriers) and on different days.

Section 6 - Governing Law

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the State of Nevada, United States, where FRM Online Endeavors LLC DBA BoxUnboxed is legally registered and holds its active business filings.

Section 7 - Financing and Third-Party Funding

We partner with third-party financing institutions, including HFS Financial, to provide our clients with accessible project funding options.

Independent Agreements: Any loan, credit extension, or financing agreement entered into is strictly a private, binding contract between the customer and the third-party lender. BoxUnboxed is not a party to the loan, does not act as the lender, and is not liable for any terms, interest rates, approvals, or disputes arising from third-party financing.

Payment Obligations: The approval or distribution of third-party financing does not alter the customer's direct financial obligation to BoxUnboxed. All custom manufacturing deposits, milestone invoices, and project balances remain due in full according to the specific schedule outlined in your BoxUnboxed design agreement, regardless of the status or timing of your lender's fund disbursement.

Section 8 - Limitation of Liability

To the fullest extent permitted by applicable law, FRM Online Endeavors LLC DBA BoxUnboxed, its members, managers, employees, agents, suppliers, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of goodwill, or business interruption, arising out of or in connection with your use of our Services or products, even if we have been advised of the possibility of such damages.

In no event shall our total cumulative liability to you for any claims arising out of or related to these Terms of Service or your use of the Services exceed the total amount you paid to BoxUnboxed for the specific product or service giving rise to the claim in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so the above limitations may not apply to you to the extent prohibited by law.

Section 9 - Dispute Resolution & Binding Arbitration

Please read this section carefully. It affects your legal rights.

Any dispute, claim, or controversy arising out of or relating to these Terms of Service, your use of the Services, or any products purchased from BoxUnboxed shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, rather than in court. The arbitration shall take place in Clark County, Nevada, or at a mutually agreed location.

Class Action Waiver: You agree that any arbitration or legal proceeding shall be conducted solely on an individual basis. You waive any right to bring or participate in any class action, collective action, or representative proceeding against BoxUnboxed.

Small Claims Exception: Either party may bring an individual claim in small claims court in Clark County, Nevada, provided the claim qualifies under that court's jurisdictional limits.

Opt-Out Right: You may opt out of this arbitration agreement by sending written notice to hello@getboxunboxed.com within 30 days of your first purchase. Opting out does not affect any other terms.
